Terms of Service

1. Acceptance of Terms

By accessing or using the iCheck mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

iCheck reserves the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.

2. Description of Service

iCheck is a social media platform that provides identity verification services through verification badges and enables creators to monetize content through private posts and subscriptions.

The App allows users to verify their identity, connect with others, and purchase or sell exclusive content.

3. User Accounts

3.1 Account Creation

You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify iCheck immediately of any unauthorized use of your account.

4. Verification Badges

4.1 Badge Types

iCheck offers various verification badge tiers that indicate different levels of identity verification. Badge availability and pricing are subject to change. Badges are non-transferable and are tied to your specific account.

4.2 Verification Process

By applying for a verification badge, you consent to iCheck's identity verification process, which may include submission of government-issued identification and other personal information. iCheck reserves the right to deny, revoke, or downgrade any verification badge at its sole discretion.

4.3 Badge Subscriptions

Verification badges are provided on a subscription basis. Subscriptions automatically renew unless cancelled before the renewal date. Refunds for badge subscriptions are provided in accordance with our refund policy.

5. Creator Program and Payments

5.1 Eligibility

To participate in the Creator Program and sell private content, you must complete Stripe Connect onboarding and comply with all applicable laws and regulations regarding content creation and sales.

5.2 Revenue Split

Creators receive 90% of revenue from private content sales and subscriptions. iCheck retains 10% as a platform fee. Payment processing fees charged by Stripe are deducted from the total transaction amount before the revenue split is calculated.

5.3 Payouts

Payouts are processed through Stripe Connect according to Stripe's payout schedule and policies. iCheck is not responsible for delays or issues related to Stripe's payment processing.

6. Private Content and Subscriptions

6.1 Purchases

When you purchase private content or subscribe to a creator, you receive a limited, non-transferable license to view that content. You may not download, redistribute, or share private content without the creator's explicit permission.

6.2 Private Preview Subscriptions

Private Preview subscriptions provide access to preview private content across the platform. These subscriptions are billed monthly or annually and automatically renew unless cancelled.

6.3 Auto-Renewable Subscriptions

Check+ verification subscriptions and Private Preview subscriptions are auto-renewable. Payment will be charged to your payment method at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

7. User Content

7.1 Ownership

You retain ownership of content you create and post on iCheck. By posting content, you grant iCheck a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the App.

7.2 Prohibited Content

You agree not to post content that:

  • Is illegal, harmful, or fraudulent
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Impersonates others
  • Violates any applicable laws

iCheck reserves the right to remove any content that violates these Terms.

8. Intellectual Property

The iCheck name, logo, and all related marks are trademarks of iCheck.

All software, design, and content provided by iCheck (excluding user content) are owned by or licensed to iCheck and are protected by intellectual property laws.

9. DMCA / Copyright Policy

iCheck respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that material on iCheck infringes your copyright, you may submit a takedown notice to our designated agent.

9.2 Required Information

A valid DMCA notice must include:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material that is claimed to be infringing, with the in-app URL or post link.
  • Your contact information (name, address, phone, email).
  • A statement of good-faith belief that the disputed use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

9.3 In-App Submission

You may submit a notice in-app via Settings → Support → Report a Copyright Issue, which routes directly to our designated agent. You may also submit a notice at icheck.inc/copyright.

9.4 Counter-Notification

If your content was removed and you believe in good faith that the removal was a mistake or misidentification, you may submit a counter-notification to our designated agent containing the elements required by 17 U.S.C. § 512(g)(3).

9.5 Repeat Infringers

iCheck will, in appropriate circumstances, terminate accounts of users who are determined to be repeat infringers. Submitting a false notice may subject you to liability under 17 U.S.C. § 512(f).

9.6 Safe Harbor

iCheck operates as an online service provider hosting user-generated content under the safe-harbor provisions of 17 U.S.C. § 512. We do not pre-screen user content and rely on this notice-and-takedown process for copyright enforcement.

10. Termination

iCheck may suspend or terminate your account at any time for violation of these Terms or for any other reason at its sole discretion.

Upon termination, your right to use the App ceases immediately. Any pending payouts for creators will be processed according to Stripe's policies.

11. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

ICHECK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ICHECK DOES NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

iCheck is a hosting platform for user-generated content. iCheck does not endorse, warrant, or assume responsibility for any user content, including its accuracy, legality, safety, or non-infringement. Users are solely responsible for the content they post.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICHECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

ICHECK'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO ICHECK IN THE TWELVE MONTHS PRECEDING THE CLAIM.

iCheck is not liable for the conduct of any user, including the content they post, the accuracy of identity verifications they submit, or interactions between users on or off the App.

13. Indemnification

You agree to indemnify and hold harmless iCheck, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the App, your content, your violation of these Terms, your violation of any law, or your violation of the rights of any third party.

14. Account Security & Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App.
  • Use bots, scrapers, or automated tools to access the App or its API.
  • Attempt to bypass authentication, rate limits, or content access controls.
  • Use another user's account, share credentials, or impersonate another person.
  • Probe, scan, or test the vulnerability of any iCheck system without prior written authorization.
  • Use the App in any way that interferes with its operation or other users' enjoyment of it.

iCheck may immediately suspend or terminate accounts engaged in these activities, and may pursue civil and criminal remedies, including under the Computer Fraud and Abuse Act (18 U.S.C. § 1030).

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

You waive any right to participate in class action lawsuits against iCheck. Either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
